Submitting a notice of claimed infringement
If you believe material available through K.O.T. infringes a copyright you own or are authorized to enforce, send a written notice to the Designated DMCA Agent above. Your notice should include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material claimed to be infringing and information reasonably sufficient for K.O.T. to locate it, such as the relevant username, keepsake, post, message context, or URL where available.
- Information reasonably sufficient to contact you, such as your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.
What happens after a notice
K.O.T. may remove or disable access to material identified in a valid notice and may notify the user who supplied the material. K.O.T. may request additional information when a notice is incomplete or the material cannot reasonably be located.
Counter-notification
If your content was removed or disabled because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may send a written counter-notification to the Designated DMCA Agent. A counter-notification should include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the appropriate U.S. Federal District Court as provided by 17 U.S.C. § 512(g), and that you will accept service of process from the person who submitted the original notice or that person’s agent.
After receiving a valid counter-notification, K.O.T. may forward it to the original claimant and may restore the affected material as permitted by applicable law unless the claimant provides notice of a court action seeking to restrain the alleged infringement.
Repeat infringers
K.O.T. may, in appropriate circumstances and at its discretion, restrict or terminate accounts of users who repeatedly infringe copyrights or other intellectual property rights.
Important note
DMCA notices and counter-notifications are legal communications. Knowingly making material misrepresentations in a notice or counter-notification may have legal consequences. If you are unsure whether material infringes your copyright, consider obtaining legal advice before submitting a notice.
